It is about rethinking the tension legality-legitimacy in democratic societies and how to advance in the constitution of a public reason that takes charge of political decisions that have to do with life and its reproduction.The question is the consideration of a displacement in that tension in which the "place" of legitimacy "runs" from legality to the margin or exteriority of the system, externality in which the particular or difference not only establish legitimacy but a universality concrete, which recognizes the political as a social transformation and life as a criterion of truth. Recognizing life as a criterion of rationality means recovering the notion of human life as an original event and a source of meaning. Just as re-thinking the notion of a body in tension with that of life allows us to approach the problem of the body from the perspective of a legitimacy constructed from the margins of the system, recognizing the legal paradox of the states of exception and of the subjects inside / outside of the law. Thinking from the category of biolegitimacy means moving from the "rules of the game" to what is at stake in it: life reduced to bare life or precarious life.We propose that biolegitimacy opens a space beyond biopolitics: that of the politics of life that, in a movement of re-politicization of the world, suppose a displacement of political forms to the subject of politics, understanding this matter precisely to life, the body and the moral choices that all politics assumes. In our Western societies, at the base of the recognition of what is institutionalized as debt or guilt, there is a crossing between the moral, the political, the economic and the legal.We propose then to re-think the question of legitimacy by genealogically analyzing the continuities between punitive and moral practices in our Western societies and analyzing the institutionalization of punishment in law. That is to say, an analysis of punishment as a problem and not as a solution, in what could be considered a punitive moment / punitive turn, which can not be resolved in our societies only on the level of law. Se trata de replantear la tensión legalidad-legitimidad en las sociedades democráticas y de cómo avanzar en la constitución de una razón pública que se haga cargo de decisiones políticas que tienen que ver con la vida y su reproducción. La cuestión es la consideración de un desplazamiento en esa tensión en que el lugar de la legitimidad se corre de la legalidad al margen o exterioridad del sistema, exterioridad en que lo particular o la diferencia no sólo instituyen la legitimidad sino una universalidad concreta, que reconoce lo político como transformación social y a la vida como criterio de verdad. Reconocer la vida como criterio de racionalidad significa recuperar la noción de vida humana como acontecimiento originario y fuente de sentido. Así como re-pensar la noción de cuerpo en tensión con la de vida permite abordar el problema del cuerpo desde la perspectiva de una legitimidad construida desde los márgenes del sistema, reconociendo la paradoja jurídica de los estados de excepción y de los sujetos dentro/fuera de la ley. Pensar desde la categoría de biolegitimidad supone pasar de las reglas del juego a lo que está en juego en él: la vida reducida a nuda vida o a vida precaria.Planteamos entonces que la biolegitimidad abre un espacio más allá de la biopolítica: el de las políticas de la vida que, en un movimiento de re-politización del mundo, suponen un desplazamiento de las formas políticas a la materia de la política, entendiendo por esta materia precisamente a la vida, el cuerpo y a las elecciones de índole moral que toda política supone. En nuestras sociedades occidentales, en la base del reconocimiento de lo que se institucionaliza como deuda o culpa se produce un cruce entre lo moral, lo político, lo económico y lo jurídico. Proponemos entonces re-pensar la cuestión de la legitimidad analizando genealógicamente las continuidades entre las prácticas punitivas y la moral en nuestras sociedades occidentales y analizando la institucionalización de la pena en el derecho. Es decir, un análisis del castigo como problema y no como solución, en lo que podría considerarse un momento punitivo/giro punitivo, que no puede resolverse en nuestras sociedades sólo en el plano del derecho . |
