Sumario:During the last 10 years the absoluteness of domain in private property has been in dispute (Art.17. N.C.) owing to the 1994 reform (art.75-17), to jurisprudence, to doctrine, because of the violations to property from those in power and by marginal social actors. The goal of this project is thus, to unveil how much of that absoluteness is contained in the Civil Code, how much is in the doctrine and jurisprudence. On that frame, we incorporate to the analysis of the different types of property: the sociological approach (social practices); the geographical approach (use of the soil and spatial organization); the political approach (social control and power), finding out in this way if we are dealing with one or with several concepts of property besides that of private property (in communality, in social function). The central hypothesis is that there is a survival of the Old Regime in power territorialization that diffuses the property concept in the Civil Code in the heterogeneity of properties. The methodology is multidisciplinary (history of law, law, political science, sociology, social psychology, social communication) but with epistemological similari-ties. The approaching multiplicity is essential to afford different perspectives to an imminent regu-lation and legislation on the indigenous communality property that clarifies the present stated problematic on this subject. How to contribute to unravel another matter related to property under the name of insecurity. To add to the formation of human resources with integral vision.
