Sumario:Aquinas understands determination as the way in which positive law derives from natural law. This derivation isn‘t deductive nor scientific. It‘s, so to speak, artistic. Although Aquinas is the philosopher who elaborates a general theory of determination, that form of derivation had already been exposed by Albert the Great. In this paper we will make an account of the Albertine explanation of determination, as well as the way in which Giles of Rome develops the doctrine of Aquinas.
