Sumario:This essay attempts to review, discuss and reconsider the current situation of urban regulation through a critical reading of the role played by local governments in the region and the contemporary urban-real estate production system. It is highlighted that, in the last decades, local governments have focused on prioritize, promote and sustain the activity of the real estate-construction sector. They have implemented strategies and public tax, financial and technical-regulatory incentives to generate an attractive "business climate" for investment. Although housing production and the real estate market have historically demanded public fiscal and tax incentives, in recent decades instruments of public-private articulation have also been implemented and legitimized, enabling the negotiation and commercialization of urban regulation.At the same time, state institutional capacities to respond to social demands are in crisis. In particular, the capacity to regulate and manage public and private interests. It is therefore essential, in the current scenario, to reposition the role of local governments and consolidate the state's capacity for urban regulation, taking into account the results and impacts -both urban and institutional- of recent experiences.
